Please read these Terms of Service ("Terms") carefully. By accessing or using our website and services you agree to be bound by these Terms. If you do not agree, do not use our site.
1. Who we are
Sugarhill Botanicals operates the website and online store at www.sugarhillbotanicals.com. References to "we", "us", or "our" mean Sugarhill Botanicals; "you" and "customer" mean any user of the Site.
2. Acceptance of orders
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including errors in product information, pricing, or suspected fraud.
After placing an order you will receive an order confirmation email. This email does not confirm acceptance of your order; a separate shipping confirmation will indicate when your order has been accepted and is being processed.
3. Products and descriptions
We make reasonable efforts to accurately describe plants, seeds, bulbs, and accessories including care information, size, and appearance. However, natural variation in live plants, seasonal changes, and photographic differences may occur.
We do not guarantee that colors, sizes, or other attributes displayed on the Site will be exact.
4. Pricing, taxes, and payment
Prices listed are in USD and are subject to change without notice.
Sales tax, VAT, import duties, and other taxes may apply and will be added at checkout where required.
We accept the payment methods displayed at checkout. Payment is processed by our payment processor; you must provide valid payment details.
All payments are final once processed, except as provided in our Return & Refund Policy.
5. Shipping, delivery and risk of loss
Shipping times are estimates only. We are not liable for delays caused by carriers, customs inspections, extreme weather, or other events outside our control.
Risk of loss and title for products pass to you upon delivery by the carrier.
International shipments may be subject to import regulations and additional charges; you are responsible for complying with local laws.
6. Order cancellations and modifications
You may cancel or modify an order within 2 hours of placement if processing has not begun. Once an order is marked as processed or shipped, we may be unable to cancel or modify it.
If cancellation is accepted after payment, refunds will follow the terms in our Return & Refund Policy.
7. Returns, refunds and replacements
Returns and refunds are handled per our Return & Refund Policy, which is incorporated into these Terms by reference.
8. Care instructions and plant health
We provide general care guidance for live plants; these are recommendations only. Proper post-delivery care is your responsibility. We are not liable for plant decline due to improper care after delivery, except where covered by our Return & Refund Policy.
9. User accounts
Creating an account may be required to place orders. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must provide accurate information and notify us of unauthorized account use.
10. Intellectual property
All content on the Site (text, images, logos, designs) is owned or licensed by us and protected by copyright, trademark, and other laws.
You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.
11. User-generated content
If you submit reviews, photos, or other content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content in connection with our business.
Do not submit content that is unlawful, infringing, or offensive. We may remove content at our discretion.
12. Prohibited uses
You may not use the Site for illegal activities, to interfere with its operation, to harvest data, or to circumvent access restrictions.
We reserve the right to suspend or terminate accounts that violate these Terms.
13. Disclaimers and limitations of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or products, including lost profits, loss of plants, or damage due to delayed delivery, except where prohibited by law.
Our total liability for direct damages is limited to the amount paid for the product giving rise to the claim.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Site.
15. Governing law and disputes
These Terms are governed by the laws of USA. Any disputes will be resolved in the courts located in USA, unless otherwise required by law.
Consumers may have additional statutory rights that these Terms do not limit where applicable.
16. Changes to these Terms
We may modify these Terms at any time. The updated Terms will be posted with a new effective date. Continued use of the Site after changes constitutes acceptance.
17. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
